Florida's JEA ratepayers could see data center cost protections under Trump pledge

Republican governors from 23 states signed onto a White House initiative requiring tech companies to pay for their own power infrastructure, but Florida Gov. Ron DeSantis was notably absent. The move could affect how Jacksonville's JEA and other utilities handle explosive data center growth.

President Donald Trump's administration expanded its Ratepayer Protection Pledge Thursday to include 23 Republican governors, a voluntary agreement designed to require data centers to pay for their own massive power infrastructure needs rather than passing costs to residential electric customers. But Florida Gov. Ron DeSantis was one of only three GOP governors who declined to sign.

The pledge, which now includes nearly 200 stakeholders from tech giants to state utilities, could reshape how municipal utilities like Jacksonville's JEA and investor-owned companies across Northeast Florida handle the region's growing data center footprint. The initiative requires companies building and operating data centers to pay directly for new power plants, substations, transmission lines and other grid upgrades their facilities demand.

What's happening

Trump first signed the Ratepayer Protection Pledge in March 2026, initially joined by tech companies Google, Microsoft, Meta, Oracle, xAI, OpenAI and Amazon. At a roundtable event at the U.S. Environmental Protection Agency on July 23, the White House announced the expansion to include Republican governors from Louisiana, Georgia, Nebraska, Idaho and 19 other states. Only three Republican governors declined: Florida's DeSantis, New Hampshire's Kelly Ayotte and Vermont's Phil Scott.

The voluntary agreement seeks to prevent a longstanding utility industry practice: spreading infrastructure upgrade costs across all ratepayers through what regulators approve in rate cases. Under the traditional model, when a utility builds a new substation or adds generation capacity to serve a large industrial customer, those capital costs are recovered through rates paid by all customers — residential, commercial and industrial alike.

The pledge coincides with federal legislative movement. The U.S. House Committee on Energy and Commerce on July 21 unanimously passed the bipartisan Ratepayer Protection Act on a 52-0 vote. Sponsored by Rep. Gabe Evans, a Colorado Republican, and Rep. Kathy Castor, a Florida Democrat representing Tampa, the bill would require state utility regulators to consider adopting standards for data centers to pay for their own electricity infrastructure. The committee narrowed the bill's scope just before passage to focus specifically on data centers rather than all large industrial loads over 100 megawatts.

According to Trump, the initiative will affect utilities supplying 80 percent of power delivered to American businesses and homes. At the EPA event, Republican governors who signed the pledge highlighted state-level deals with tech companies. Louisiana Gov. Jeff Landry said his state's agreement with Meta will "save Louisiana $2.6 billion," while Georgia Gov. Brian Kemp said the approach will support nuclear plant operations while keeping rates low.

What this means for JEA and Jacksonville ratepayers

Jacksonville's JEA, one of the nation's largest municipal utilities, would face direct implications if Florida adopts the pledge framework, whether through voluntary commitment or eventual state legislation. Data centers require extraordinary amounts of electricity — a single large facility can demand 50 to 200 megawatts or more of continuous power, equivalent to a small city. Projects of this scale typically trigger utility capacity studies to determine whether existing substations, transmission lines and generation resources can handle the load, or whether new infrastructure must be built.

Under the traditional utility model, JEA would build the required infrastructure — perhaps a new substation costing $15 million to $40 million, or transmission line upgrades in the tens of millions — and recover those costs through its rate base over the asset's depreciation period. That means all JEA electric customers in Jacksonville and the beaches would see incremental rate pressure as the utility's capital investments grow. The municipal utility serves roughly 465,000 electric customers across Duval, Nassau, St. Johns and Clay counties.

The Ratepayer Protection framework would shift that burden. A data center developer or tech company leasing the facility would negotiate directly with JEA to pay for dedicated infrastructure through upfront contributions, ongoing surcharges tied to their consumption, or separate service agreements outside the standard rate structure. This arrangement is not without precedent in Florida — large industrial customers sometimes fund their own infrastructure extensions — but applying it systematically to an entire industry sector would be new territory for JEA's board and management.

The key open question for Jacksonville ratepayers is what happens if DeSantis's decision not to sign the pledge signals Florida will not pressure utilities to adopt these cost-shifting standards. That would leave JEA's elected board and management to decide the issue on a project-by-project basis, balancing the utility's mandate to provide reliable service against the goal of keeping rates stable for residential customers who have no voice in whether a data center locates here.

Impact on Northeast Florida's development pipeline

The pledge and potential federal legislation arrive as Northeast Florida positions itself in the national data center site-selection competition. The region offers key advantages: JEA's generation capacity and transmission access, relatively low risk of hurricanes compared to South Florida, available industrial land at Cecil Commerce Center and along the I-95/I-295 corridors, and fiber connectivity through JAXPORT and intercity routes.

Data centers are a coveted economic development prize because they bring massive property tax revenue and, in Florida's environment, typically seek neither property tax abatements nor other incentives that erode the fiscal benefit. A $500 million data center on a 20-acre site produces far more tax base per acre than a distribution warehouse. However, they create few permanent jobs relative to their capital investment — often only 20 to 50 full-time positions for a large facility, mostly technical roles — and contribute little to the retail or housing markets that drive broader community benefits.

If the Ratepayer Protection framework discourages data center developers from choosing locations where utilities cannot or will not agree to cost-shifting arrangements, Northeast Florida's competitive position would depend heavily on how JEA, Clay Electric Cooperative, Florida Power & Light (which serves parts of St. Johns, Flagler and Nassau counties), and Duke Energy (small portions of the region) respond. The political and regulatory environment matters: Florida's Public Service Commission regulates investor-owned utilities like FP&L and Duke, but JEA answers to its independent board and ultimately the Jacksonville City Council, giving the community more direct leverage over the terms of any data center service agreements.

The environmental dimension also weighs on site selection. Data centers require substantial water for evaporative cooling unless they use costly closed-loop systems, and large installations can draw millions of gallons per day — a concern in Northeast Florida where St. Johns River Water Management District regulates consumptive use permits and groundwater withdrawals from the Floridan Aquifer are closely monitored in coastal areas vulnerable to saltwater intrusion. A developer facing requirements to fund both dedicated power infrastructure and advanced cooling systems to minimize water use would evaluate whether the site still pencils out economically.

What the data center industry says

The Data Center Coalition, an advocacy group representing Amazon, Microsoft, Google and other major operators, opposed the narrowing of the House bill to target only data centers. In a statement July 22, the coalition's president and CEO Josh Levi argued the changes "single out the data center industry, leaving everyday Americans vulnerable to the costs associated with large load growth from other industries as they continue to expand operations in the U.S."

The industry's position reflects a broader debate over how to allocate grid modernization costs in an era of rapid electrification. Manufacturing plants, chemical facilities, electric vehicle charging networks and cryptocurrency mining operations also impose large, lumpy loads on the grid, yet the federal legislative push and White House pledge focus exclusively on AI-related data centers. Industry representatives contend this creates an uneven playing field and could push investment offshore or to regions with less stringent cost-recovery rules.

Environmental advocacy groups dispute the administration's claims that the pledge will lower residential electricity costs. Climate Power, an environmental organization, released a report July 23 stating that electricity prices have risen 18 percent on average since Trump took office and cited rate increases in Missouri, North Carolina, Connecticut, New Mexico and Oregon tied to other factors. The group characterized the pledge as a public relations effort that does not address underlying drivers of utility rate growth, including fossil fuel price volatility and grid resilience investments following extreme weather events.

Meanwhile, progressive Democrats including Rep. Alexandria Ocasio-Cortez of New York and Sen. Bernie Sanders of Vermont have introduced parallel bills to impose a national moratorium on AI data center construction until Congress addresses economic, environmental and safety concerns. New York became the first state to enact such a ban last week. No similar legislation has gained traction in Florida's Republican-controlled legislature, where economic development and business-friendly policies typically prevail over precautionary restrictions.

What happens next

The Ratepayer Protection Act now advances to the full House for a floor vote, with timing uncertain but likely before the August recess. If it passes the House, the bill would move to the Senate, where its fate is less clear given the narrower Republican majority and ongoing debates over federal versus state authority in utility regulation. Florida utilities and the state Public Service Commission would need to determine how to implement any federal standards requiring consideration of data center cost-shifting.

At the state level, the key question is whether Florida's legislature or Gov. DeSantis will address the issue in the 2027 session. DeSantis's decision not to sign the voluntary pledge does not bind the legislature, which could enact its own version of ratepayer protection standards. Utility regulation is a state function in most contexts, and the Florida PSC has broad authority to approve or reject rate structures for investor-owned utilities, while municipal utilities like JEA operate under their own governance frameworks subject to local oversight.

For JEA specifically, any policy direction would likely emerge through the utility's board meetings, which are public and typically held monthly. The board approves major capital projects, service agreements with large customers and rate adjustments. If a data center developer approaches JEA with a project requiring dedicated infrastructure, that negotiation would produce a term sheet or service agreement that the board would review in open session, giving Jacksonville residents and ratepayer advocates an opportunity to weigh in before any commitments are finalized.

The House committee's bill requires state regulators to "consider" adopting standards but does not mandate specific outcomes, leaving substantial flexibility for states like Florida to tailor approaches to their markets. Whether that consideration results in binding rules, voluntary guidelines or no action at all would depend on stakeholder input through the PSC's rulemaking process and the political priorities of state leadership.

The debate over data center costs lands in Northeast Florida at a moment of broader infrastructure pressure. The region's explosive residential growth — St. Johns County consistently ranks among the nation's fastest-growing — already strains road capacity, school systems and water resources. Adding industrial-scale power demand from data centers without a clear framework for who pays introduces another variable into the complicated calculus of managing growth while maintaining quality of life and fiscal sustainability. How JEA, local governments and state regulators navigate the next 12 to 18 months will shape whether Northeast Florida becomes a data center hub and on what terms those facilities arrive.
